These Terms & Conditions/Terms of Service (“Terms”) govern the “Beat The Freeze: Idaho's Ultimate Furnace Giveaway” (the “Giveaway”) sponsored by AdvantaServ (“Sponsor,” “we,” “our,” or “us”). By entering, you agree to be bound by these Terms, the decisions of Sponsor, and applicable law. If you do not agree, do not participate.

All notices, requests, and questions regarding this Giveaway must be submitted using the contact information provided.

2. Eligibility

Age & Residency

Open only to legal residents of Idaho who are 18 years or older at the time of entry.

Homeowner Requirement

Entrant must be a current Idaho homeowner (not a renter).
Proof of ownership may be required (deed, tax record, mortgage statement, etc.).

Service Area Definition

Eligible properties must be located within AdvantaServ’s standard Idaho service area, defined as either:

  • Within a 100-mile radius of AdvantaServ's base of operations in Idaho Falls, Idaho, OR

  • Any location AdvantaServ reasonably determines to be within serviceability based on practical routes, staffing, permitting, winter access, and safety requirements.

AdvantaServ will determine eligibility using mapping tools and operational criteria.

Decision-Maker Requirement

Entrants must be the primary purchasing/repair decision-maker for the home’s heating system.

Exclusions

Employees, officers, directors, contractors, and immediate household members of AdvantaServ are not eligible.

Void Where Prohibited

The Giveaway is void outside Idaho and in any jurisdictions where restricted by law.

Verification

AdvantaServ may require:

  • Government-issued ID

  • Proof of homeownership

  • Proof of property location

  • Confirmation the property is safe and suitable for installation

Failure to provide requested documentation may result in disqualification.

3. Giveaway Period; No Purchase Necessary

Giveaway Period

The Entry Period begins on the date/time listed on the landing page and ends 14 days later.

No Purchase Necessary

A purchase does not increase the odds of winning.

One Entry Per Household

Limit one (1) entry per household/property.
Duplicate, fraudulent, or automated entries are void.

4. How to Enter

Entrants must complete the official entry form during the Entry Period, including accurate:

  • Name

  • Email

  • Phone

  • Home address

  • Furnace/System details

  • Referral information (if applicable)

  • Additional required fields

Incomplete, inaccurate, or false entries are void.

5. Referral Mechanic – “Win One, Gift One”

To be eligible for the referral prize:

  • Entrant must list a referrer at the time of entry on first/original submission.

  • Referrer information cannot be added or edited after submission.

  • Self-referrals are invalid.

  • The referrer must also enter the giveaway.

  • Referrer must independently meet all the same eligibility rules.

If multiple names are submitted, only the first valid referrer recorded by the system will be recognized.

AdvantaServ may disqualify entries that:

  • Use multiple identities

  • Attempt to manipulate entry limits

  • Automate or script entries

  • Interfere with the operation of the Giveaway

6. Prizes & Approximate Retail Value (ARV)

Grand Prize

Winner(s) will receive a complete high-efficiency furnace system, including:

  • Furnace equipment

  • Controls

  • Standard installation

  • System commissioning

  • Standard duct modifications

All up to a maximum value of $10,000 (the “Prize Cap”).

ARV: Up to $10,000 per winner.
Prizes have no cash value, are non-transferable, and cannot be exchanged except at AdvantaServ’s discretion.

“Win One, Gift One” Mechanic

If the primary winner listed a valid referrer:

  • The referrer will also receive the same furnace system,

  • Up to the same $10,000 Prize Cap,

  • Installed under the same terms and conditions,

  • For their own eligible Eastern Idaho property.

Maximum winners under this mechanic: two (2) — the primary winner and one valid referrer.

If no valid referrer is provided, only the primary winner receives a prize.

Furnace Winner’s Bonus (Non-Winners)

Eligible non-winners may receive:

  • 10% off any complete furnace installation.

  • Plus 12 months free of AdvantaPlan (priority scheduling, emergency winter service, included membership benefits)

To qualify, installation must be scheduled by the end of 2025.

Offer is limited by capacity, non-transferable, and may not be combined with other promotions.

7. Scope of Prize; Costs Above Prize Cap

The prize covers all standard furnace installation components and labor up to the $10,000 cap.

If total installation costs exceed the Prize Cap, the winner is responsible for all additional costs.

Examples of potential extra-cost items include (non-exhaustive):

  • Extensive ductwork redesign/replacement

  • Electrical panel upgrades, breakers, wiring corrections

  • Gas line rerouting, upsizing, or safety valve replacement

  • Code-required ventilation or combustion air upgrades

  • New drain lines, condensate pumps

  • Significant return-air modifications

  • Asbestos abatement

  • Attic or crawlspace remediation

  • Structural or drywall modifications

  • Winter weather access complications

  • Permit fees above standard local allowances

AdvantaServ will disclose any expected overages before work begins.

Winner may decline overages; Sponsor may then:

  • Adjust the scope to fit the Prize Cap, or

  • Offer alternative equipment of comparable value

8. Home Suitability; Permits; Scheduling; Winner Obligations

Site Assessment

AdvantaServ must confirm:

  • Installation feasibility

  • Code compliance

  • Safe working conditions

  • System sizing requirements

  • Ductwork compatibility

  • Adequate access

If the site is unsuitable, AdvantaServ may:

  • Recommend alternate solutions

  • Offer equivalent services

  • Provide different equipment within the Prize Cap

Permits & 811 Locates

AdvantaServ will obtain all standard permits and utility locates.

Non-standard permitting, engineering, or remediation expenses are the winner’s responsibility.

Home Access

Winner must provide:

  • Lawful, safe property access

  • Clear work areas

  • Unrestricted entry for crews and equipment

  • Secured pets

  • Driveway/yard access suitable for winter installation

Scheduling

Winner must be available for scheduling and communication.

Installation must begin within 60 days of winner verification, subject to:

  • Weather

  • Safety conditions

  • Permit timing

  • Equipment availability

  • Winter travel conditions

  • Emergency service demands

AdvantaServ aims to install within 14 days whenever feasible.

Cooperation

Winners must:

  • Sign standard work orders

  • Approve any overages

  • Sign completion documents

  • Provide accurate information

9. Winner Selection; Verification; Odds

Selection

Winner(s) will be selected at random within 24 hours of Giveaway closing.

Notification

Winners will be notified by phone and email.
They must respond within 48 hours.

Failure to respond or complete verification may result in disqualification and the selection of an alternate.

Odds

Odds depend on the number of eligible entries received.

Referral does not change odds of the primary draw; it adds an additional prize for a valid referrer.

Disqualification

AdvantaServ may disqualify entrants for:

  • Fraud

  • Non-eligibility

  • Harassment or threats

  • Tampering

  • Abuse of staff

  • Unsafe behavior

  • Violations of these Terms

10. Taxes & Reporting

Winners are responsible for:

  • Any applicable income, property, or local taxes

  • Any installation costs above the $10k Prize Cap

AdvantaServ may issue an IRS Form 1099-MISC.

11. Warranty, Insurance & Liability Limits

Warranty

Prize installations include AdvantaServ’s standard equipment and workmanship warranties.

Insurance

Sponsor maintains appropriate liability insurance and uses licensed personnel where legally required.

Limitation of Liability

To the fullest extent permitted by law, Sponsor’s total liability shall not exceed the ARV of the prize ($10,000).

Sponsor is not responsible for:

  • Technical failures

  • Internet outages

  • Lost or misdirected communication

  • Acts of God

  • Extreme weather

  • Supply shortages

  • Power outages

  • Road closures

  • Third-party platform failures

Assumption of Risk

Winner acknowledges inherent risks of HVAC installation and agrees to follow all site-safety instructions.

12. Publicity Release

By accepting the prize, winner and valid referrer grant AdvantaServ a perpetual, worldwide, royalty-free license to use:

  • Name

  • City/state

  • Likeness

  • Voice

  • Photos/videos

  • Testimonials

  • Before/after installation content

for marketing, advertising, and promotional use in any media, without further compensation.

13. Privacy & Data Use

AdvantaServ collects:

  • Personal information (name, email, phone)

  • Property address

  • Furnace/system details

  • Referral data

  • Automatically collected device/IP data

Data is used for:

  • Giveaway administration

  • Eligibility verification

  • Home assessment

  • Scheduling

  • Follow-up communication

  • Marketing (email/SMS with consent)

  • Fraud prevention

Entrants may opt-out of marketing at any time (reply STOP to SMS).

AdvantaServ does not sell or rent personal data.

14. Code of Conduct; Disqualification

Sponsor may disqualify any entrant who:

  • Provides false information

  • Attempts to manipulate the Giveaway

  • Harasses or threatens staff

  • Violates laws or rules

  • Creates unsafe site conditions

  • Interferes with the Giveaway

AdvantaServ may also ban such individuals from future promotions.

15. Disputes; Governing Law; Arbitration

  • Governing law: State of Idaho

  • Binding arbitration in Bonneville County, ID

  • Class action waivers apply

  • Small claims court option for qualifying claims

AdvantaServ may seek injunctive relief to protect intellectual property and publicity rights.

16. Cancellation; Modification

AdvantaServ may modify, suspend, or terminate the Giveaway if it cannot proceed due to:

  • Weather

  • Acts of God

  • Technical issues

  • Fraud

  • Supply shortages

  • Winter emergency demands

  • Other causes beyond Sponsor’s control

If terminated early, winners may be selected from all valid entries received to that point.

17. Installation Acceptance

Winner must sign:

  • Standard installation work order

  • Completion/acceptance form

Title to installed equipment transfers according to Idaho law after completion.

18. Miscellaneous

  • These Rules and the entry form constitute the entire agreement.

  • If any provision is held invalid, the remainder remains in effect.

  • Sponsor may assign these Terms; entrants may not.

  • Headings are for convenience only.
